Same Travel Rule framework as BTC sends (FinCEN's $3K threshold for VASP-to-VASP exchanges of originator + beneficiary information). Sending ETH is not itself a taxable event for own-custody transfers. Sending ETH as PAYMENT or to a third party IS a taxable disposal at FMV on send date. ETH-specific: smart-contract sends (interacting with DeFi protocols) can have HIDDEN taxable events embedded in the transaction (e.g., a swap inside the contract). The IRS treats each smart-contract event with a beneficial-ownership change as a separate disposal. Documentation for complex transactions is your responsibility.

Common gotchas

  • Gas fees are paid in ETH, denominated in gwei (1 gwei = 10^-9 ETH). The dollar cost floats with ETH price + base-fee level. Check mempool tools (etherscan.io/gastracker or ethgas.watch) before sending to avoid paying 3-5x base fee.
  • EIP-1559 burns the base fee (it's removed from circulation, not paid to validators). The priority tip goes to validators. When sending, you set max_fee and max_priority_fee — venues typically auto-set these but Pro users can override.
  • Layer 2 withdrawals from a CEX to an L2 (Arbitrum, Base, Optimism) save 10-50x in gas vs mainnet — but the L2 has different finality assumptions (optimistic rollup with 7-day challenge window vs ZK rollup with cryptographic finality). Don't withdraw to an L2 you don't intend to USE — bridging back to mainnet later may cost more than the original mainnet withdrawal would have.
  • ENS names (.eth addresses) are convenient but FAILURE-PRONE — typos, expired domains, or compromised ENS-name owners can route funds to wrong destinations. Always verify the underlying 0x... hex address an ENS name resolves to, especially for first sends. Some wallets show both side-by-side.
  • Smart-contract interactions (DeFi sends, NFT trades, swap routers) consume gas + can revert. A reverted transaction still costs gas. Set the gas LIMIT generously (typical txn ~21000 gas; contract interactions often 100K-500K+). Out-of-gas reverts are the most common reason on-chain ETH transactions fail.

Step-by-step

  2. Pick the chain: mainnet vs L2. For long-term hold or amounts > $5K: mainnet. For active DeFi use or low-value sends < $500: L2 (Arbitrum/Base/Optimism).
  3. Check current gas + set fees. etherscan.io/gastracker shows current base fee + priority tips. For non-urgent sends, use 'Standard' priority (~30 sec confirmation). For urgent, 'Fast' (~10 sec).
  4. Execute a test send for new destinations. Send 0.001-0.005 ETH first ($3-$15). Wait for 1 confirmation. Verify it landed correctly. Then send the rest.
  5. Wait for confirmations. 1 confirmation in 12-30 seconds; 12+ confirmations (~3 min) is conventional for finality on mainnet. L2 finality varies by L2 design (Arbitrum: ~7-day challenge window for full mainnet finality, but practically final on L2 in seconds).
  6. Track the disposal if it's a payment. Own-custody send = no tax event. PAYMENT or third-party send = taxable disposal at ETH FMV on send date. Smart-contract interactions may embed multiple taxable events — document each.
